This California Privacy Policy supplements the AssuranceAmerica Privacy Policy and applies solely to residents of the State of California. This policy describes how the AssuranceAmerica Companies may collect, use, disclose, share, sell, or otherwise process personal information relating to California residents in accordance with the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”).

For purposes of this California Privacy Policy, “personal information,” “sell,” “share,” “business purpose,” “commercial purpose,” and similar terms have the meanings provided under applicable California law.

For purposes of this policy, the “AssuranceAmerica Companies” include AssuranceAmerica Group, Inc., AssuranceAmerica Corporation, AssuranceAmerica Managing General Agency, LLC (CA DBA AssuranceAmerica Managing General Insurance Agency, LLC – License #0F49773), AssuranceAmerica Insurance Company, InsureMax Insurance Company, AssuranceAmerica Commercial Corporation, Catawba Insurance Company, and AssuranceAmerica Commercial Managing General Agency, LLC, together with their respective parent companies, subsidiaries, and affiliated entities.

Certain affiliated companies within the AssuranceAmerica corporate family may operate independent services, websites, or digital platforms and maintain their own privacy policies. When individuals interact directly with those platforms or services, the privacy policy applicable to those services will govern the collection, use, and disclosure of personal information in connection with those services.

This California Privacy Policy applies to personal information collected through websites and digital platforms operated by AssuranceAmerica Managing General Agency, LLC (“AAMGA”), as well as personal information collected through insurance applications, claims processes, customer service interactions, marketing activities, website operations, and other business operations of the AssuranceAmerica Companies.

Certain personal information collected in connection with insurance products may also be subject to federal or state financial privacy laws, including the Gramm-Leach-Bliley Act (“GLBA”). To the extent that personal information is subject to those laws, certain rights under the CCPA may not apply.

The AssuranceAmerica Companies do not collect biometric identifiers such as fingerprints, facial recognition data, retinal scans, voiceprints, or similar biometric information.

Sources of Personal Information

We may collect personal information directly from individuals when they request insurance quotes, apply for insurance products, communicate with our representatives, submit forms through our websites, or otherwise interact with the AssuranceAmerica Companies.

We may automatically collect information when individuals access or interact with websites or digital platforms operated by AAMGA using cookies, pixels, web beacons, analytics technologies, and similar tracking tools.

We or our service providers may also use session replay technologies, interaction monitoring tools, or similar technologies that record or analyze interactions with websites or digital platforms. These technologies may capture information such as mouse movements, click activity, scrolling behavior, page navigation, and interactions with website forms.

Session recording technologies may be operated by the AssuranceAmerica Companies or by third-party technology vendors acting on our behalf. These technologies may be used for fraud prevention, security monitoring, analytics, dispute resolution, compliance, quality assurance, operational performance, and improving website functionality and user experience.

By accessing or using our websites or digital platforms, you acknowledge and consent to the use of cookies, analytics technologies, and session recording, replay, and interaction monitoring technologies to monitor and analyze interactions with our websites to the extent permitted by applicable law.

We may also obtain personal information from third parties including insurance agents or brokers, consumer reporting agencies, identity verification providers, marketing partners, analytics providers, technology vendors, affiliated companies, and publicly available sources.

Purposes for Collecting and Processing Personal Information

We may collect, use, process, disclose, share, or sell personal information for any lawful business or commercial purpose permitted by applicable law. Such purposes may include providing insurance quotes and products, underwriting and administering insurance policies, processing claims and payments, communicating with customers, improving digital services, conducting analytics and research, detecting and preventing fraud, protecting the security and integrity of systems, marketing products or services, supporting operational and administrative functions, and complying with legal or regulatory obligations.

Personal information may be disclosed to service providers, technology vendors, analytics providers, marketing vendors, payment processors, customer service providers, and professional advisors that assist us in operating our business.

The AssuranceAmerica Companies may also disclose personal information to service providers, technology vendors, analytics providers, marketing partners, and other authorized third parties that assist in operating our business, including vendors that provide artificial intelligence, machine learning, analytics, or automated decision-support technologies, provided that such parties process personal information only for authorized business purposes consistent with applicable law and contractual obligations.

Personal information may also be shared with affiliated companies within the AssuranceAmerica corporate family, as well as insurance carriers, managing general agencies, agents, brokers, reinsurers, and other entities involved in underwriting, issuing, servicing, or supporting insurance products or services.

Certain privacy laws define the terms “sell” and “share” broadly. Under these definitions, some disclosures of personal information for analytics, marketing, advertising, technology services, or other business purposes could be characterized as a “sale” or “sharing” of personal information.

California Privacy Rights

Subject to certain limitations under applicable law, California residents may have the right to request access to personal information collected about them, request deletion of certain personal information, request correction of inaccurate personal information, request information about categories of personal information disclosed to third parties, request to opt out of the sale or sharing of personal information, and request to limit certain uses or disclosures of sensitive personal information.

California residents also have the right not to receive discriminatory treatment for exercising privacy rights under the CCPA.

Personal information may be retained for as long as reasonably necessary to fulfill the purposes described in this California Privacy Policy, including compliance with legal, regulatory, accounting, and insurance recordkeeping requirements, or for other lawful business purposes.
